REGULAR BOARD MEETING for August 21, 2012

Meeting was called to order at 9:00 a.m., by: Chairman Ewen:
followed by the Pledge of Allegiance led by Keith Grant. Chairman
Ewen recognized guests. Motion was made by Keith Grant and
seconded by Thomas S. Hinman to approve the agenda. Motion
passed unanimously.
William Bridges, Pryor Mountain Engineering; Carl Meyer,
Airport Manager:
William Bridges and Joy Hill requested an executive session.
9:03: Motion was made by Thomas S. Hinman and seconded by Keith
Grant to go into executive session to discuss personnel issues. Motion
passed unanimously. 9:09: Chairman Ewen reconvened the regular
meeting. Motion was made by Keith Grant and seconded by Thomas
S. Hinman to accept the recommendation from the Engineer to adjust
an employee's time and schedule. Motion passed unanimously.
William Bridges and Joy Hill discussed the remodel of the Land
Planning Office and reviewed the remodel of the basement and Carl
Meyer's office. William would like to provide more usable space in
the basement of the land planning office. He would like to replace the
windows and estimated the entire project to cost $15,000.00. Motion
was made by Thomas S. Hinman and seconded by Keith Grant for
Engineer to proceed with the Land Planning office remodel as
suggested. Motion passed unanimously.
Cemetery Road: William said the contractor will do chip seal on
Thursday and Friday.
Cold Springs Road: William said the sub-contractor had
completed most of the punch list and will finish this week. He said it
was a good surface. Keith Grant recommended a double chip seal on
all approaches on chip-sealed roads.
Road 5: William said the contractor will start the work after Labor
Day.
William said Jerry Denniston and State inspectors inspected the
fuel tank for the South end Road and Bridge. The State refused approval
because the county can't provide a"spill prevention plan." He also said
Rod Wambeke wasn't sure where the North end spill prevention plan
was either. William wants to get a new one done and sub mit it to the State.
Commissioners agreed by consensus have William Bridges proceed
in getting a new "spill prevention plan".
Eagle Pass Community Pit: William said he sent a letter to the
BLM and hadn't heard back from them yet. He will follow-up with the
BLM.
Wyoming Ave.: William said he hadn't received any information
back regarding the acquisition of an easement. He said he would
prepare a letter and send it out to the landowners.
Bear Creek Road: William said the county road ends
approximately 9/10 of a mile south of the culvert, clearly placing the
culvert on private property. Commissioners agreed that no more
gravel should be placed beyond the property line.
Lane 35: William said he found no record of County ownership
to this road. He also said there is no land-lock to the one land owner
out on the road. He said he will research it more but wanted to make
the Commissioners aware of it. He will visit with Ken Fink for more
information.
William presented and recommended a utility license and an
access permit. Motion was made by Keith Grant and seconded by
Thomas S. Hinman to approve utility license from Rob Lunder (MDU)
for Road 11 to install new PE Gas service line, and for Permit to
Construct Access Driveway from American Colloid for Road 7 l& in
Cowley as presented. Motion passed unanimously.
Lovell Refinery: William said the new test holes found additional
contaminants and there were plans being made for remediation. Keith
Grant said the County was originally.told there would be no cost to the
County for the clean-up.
William presented a change order. Motion was made by Thomas
S. Hinman and seconded by Keith Grant to sign the Change Order
for the Road Sign Installation Project to include additional address
markers. Motion passed unanimously. Keith Grant said he felt the
Road and Bridge departments could handle installing new signs in
the future.
William said he and Becky Lindsey submitted the County Road
Fund Annual Report on time. He reported that WYDOT requested
an invoice for FEMA emergency monies used on repairs done to the
Paintrock bridge for which they will reimburse the County. The Clerk
asked for the reimbursement funds to be put in the general fund then
transferred to the county road fund.
Chairman Ewen said he had received a citizen complaint on the
Greybull River Road. Erosion along the edge of the pavement has
created a drop-off which creates an unsafe condition. William Bridges
said he will research it more and report back to the Commission.
Carl Meyers, Big Horn County Airport Manager, presented a
request for a journal entry to pay a late bill in the amount of 93,800.00.
Commissioners agreed by consensus to approve the transfer of funds.
Carl Meyer will advise GDA to bill in a more timely manner.
Carl Meyer said he would conduct a thorough review of the
insurance coverage on airport buildings and report his findings at the
next meeting.
Airport Report: Carl presented his monthly report which is now
on file at the county clerk's office.
10:20: Chairman Ewen called for a break; resumed regular
session at 10:33.
Carl presented an RFR for North Big Horn County Airport #5 for
signature. Chairman Ewen signed.
Accounts Payable: Marquerite Van Dyke and Carol Willard
presented the current Big Horn County bills for approval. Carol
Willard discussed worker compensation claims and sick leave policy
issues. Motion was made by Keith Grant and seconded by Thomas
S. Hinman to approve & pay the bills and payroll. Motion passed
unanimously. Carol will revise the policy of wellness incentive and
payout according to recommendations by the commissioners and
update the County Personnel Policy accordingly.

Doff Noyes presented draft Minutes for the Regular Board
Meeting of August 7, 2012. Motion was made by Thomas S. Hinman
and seconded by Keith Grant to approve the Minutes as corrected.
Motion passed unanimously.
Dori Noyes said no applications had been received for the Weed
& Pest Board. Wendy Thulander reported that Ruth Zeller said the
Weed & Pest Board has been advised of this. Keith Grant took an
application form for a potential appointee. This issue will be tabled
until the next meeting,
Doff Noyes presented a lease agreement for the South Big Horn
County Senior Center. Motion was made by Thomas S. Hinman and
seconded by Keith Grant to sign the lease. Motion passed unanimously.
The new lease has been reviewed and approved for form by Michelle
Burns, Big Horn County Attorney.
Dori Noyes presented a salary agreement with the University of
Wyoming for the Big Horn County Educator. Motion was made by
Keith Grant and seconded by Thomas S. Hinman to sign. The Motion
passed unanimously.
11:30: Sheriff Blackburn, Michelle Burns, and Julie Faber: Sheriff
Blackburn requested an Executive Session. Motion was made by
Thomas S. Hinman and seconded by Keith Grant to go into executive
session to discuss inmate health issues. Motion passed unanimously.
11:50: Chairman Ewen reconvened from executive session into
regular session. No action taken.
Dori Noyes presented a letter of resignation from Vickie Larchick,
Clerk of District Court. Chairman Ewen expressed admiration and
appreciation for Vickie's services to the County and said she will be
missed and hard to replace. Dori Noyes will draft a letter to the Big
Horn County Republican Party to start the process of appointing a
replacement. She will have the County Attorney review it and will
bring it back to this meeting for signatures.
12:03: Motion was made by Thomas S. Hinman and seconded by
Keith Grant to adjourn for lunch. Motion passed unanimously. The
meeting was reconvened at 13:00.
Marquerite Van Dyke presented a drawdown request for Maria
Eastman, Grants Administration, for the Big Horn County Boiler
Project #13. Chairman Ewen signed.
Joy Hill and Nick Wilson, Big Horn County Land Planning Office:
Nick Wilson presented the Heritage, FLP (Hopkin) Subdivision SS 12-
002 for approval. Motion was made by Keith Grant and seconded by
Thomas S. Hinman to approve. Motion passed unanimously.
Land Planning Report: Joy presented her monthly report which
is now on file at the county clerk's office.
Joy presented an application to attend the FEMA Flood Plain
Training in Maine, to be paid for by FEMA. Commissioners agreed by
consensus. Chairman Ewen signed.
Joy said there will be a P & Z meeting on Sept. 114.
Wendy Thulander presented a malt beverage liquor license
application from Shell Campground LLC, to begin 8/21/12 and ending
on 5/14/2013. Sheriff Blackburn attended the meeting to review the
application. Motion was made by Thomas S. Hinman and seconded
by Keith Grant to approve and sign the application. Motion passed
unanimously.
Dori Noyes presented an application from the Byron Bar LLC
(dba) Byron Bar & Grill, for a 24 hour liquor license permit starting
at 3:00 PM, September 1, 2012, and ending at 2:00 AM, September
2. Sheriff Blackburn attended the meeting to review and approve the
application. Motion was made by Keith Grant and seconded by Thomas
S. Hinman to approve the request. Motion passed unanimously.
Doff Noyes presented Big Horn County School District Number
3 school bond resolutions for informational purposes.
Gina Anderson, Big Horn County Assessor, presented the
irrigation districts assessment rolls. Motion was made by Keith Grant
and seconded by Thomas S. Hinman to adopt Resolution (2012-2013)
No. 6 August 21, 2012 establishing the assessment rolls. Motion
passed unanimously.

of County Commissioners, sitting as a Tax Levy Board at Basin,
Wyoming, August 7, 2012, be and the same hereby are approved
and it is further ordered that the minutes of said meeting be filed
and recorded in the office of the County Clerk of Big Horn County,
Wyoming.

Gina presented the Certification of Levy Assessment for Big
Horn Canal's Roll. Chairman Ewen signed and Doff Noyes attested.
No motion required.
Becky Lindsey, Big Horn County Treasurer, reported that she
will have the Title III Funds and Direct Distribution information ready
for the next Commission Meeting. Becky also advised she would meet
with Dan Anders, South Search and Rescue; Brent Godfrey, BHC Fire
Chief; Ken Blackburn, BHC Sheriff; and Scott Ailred, North Search
and Rescue, on the Firewise funds and their designation then report
back to the Commission.
2:26: Chairman Ewen called for a Break. Regular meeting was
reconvened at 2:39.
2:40: Marquerite Van Dyke and Carol Willard requested an
Executive Session to discuss personnel issues. Motion was made by
Keith Grant and seconded by Thomas S. Hinman to go into executive
session. Motion passed unanimously. Regular session was reconvened
at 2:47. No action taken.
Dori Noyes presented a letter to the Big Horn County Republican
Party Central Committee to start the process of appointing a
replacement for the Clerk of District Court. Motion was made by Keith
Grant and seconded by Thomas S. Hinman to sign the letter, which will
request the Big Horn County Republican Party to select and submit
the names of three qualified people to the Commission for selection
and appointment to the position. Motion passed unanimously.
Michelle Burns approached the Commission to request the
addition of a contracted attorney to assist the Commission in civil
matters. She said there are projects that need to be immediately
addressed and that Title 18 of the statutes allows an attorney to be
contracted. Chairman Ewen asked Michelle to prepare an RFP for
this position. Michelle Burns agreed to write a draft RFP for the
Commission to review.

Tax deed notice
NOTICE OF INTENT TO APPLY FOR TAX DEED
NOTICE IS HEREBY PROVIDED that Cary IC Norman intends
to apply to the Big Horn County Treasurer for a tax deed and in com-
pliance with W.S. §39-13-108 supplies the following information:
1. Cary K. Norman purchased the real property described herein
by way of a Certificate of Purchase of Real Estate for Taxes dated Sep-
tember 15, 2010, for irrigation taxes for the year 2009.
2. The real property was taxed in the name of the Estate of Patri-
cia J. Asay, a/k/a Patricia Jean Asay Estate and Necoline D. Asay and
is reflected in the records of the Big Horn County Treasurer as parcel
no. 99-00-009-00163-T.
3. A description of the real property: Lot 7 of the Flood Subdivi-
sion in the North V2 of Lots 69-A and 69-B, in Township 56 North,
Range 96 West of the 6th EM., Big Horn County, Wyoming, some-
times described as the East 130 feet of the North V2 of Lot 69-B of
said township and range. The address of the property is shown in the
records of the Big Horn County Assessor as 1160 Lane 12, Lovell,
Wyoming.
4. The property was taxed or assessed for irrigation assessments
for 2009 and 2010.
5. The time of redemption expired March 15, 2012.
6. Application for a tax deed will be made not less than three
months from when this notice is served on each person in actual pos-
session or occupancy of the real property and the person in whose
name the property was taxed or assessed, if upon diligent inquiry the
person(s) can be found in the county and in lieu thereof, completion of
service by publication as allowed by statute 39-13-108 in the event that
no person is in actual possession or occupancy of the property and if
the person in whose name the property was taxed or assessed cannot
be found in the county.
7. The taxes assessed for the property described herein are ir-
rigation assessments. There are no amounts representing special as-
sessments for local or public improvements.
