September 4. 2012 MINUTES OF THE BIG HORN COUNTY COMMISSIONERS' REGULAR BOARD MEETING for September 4, 2012 Name: Big Horn County Commissioners "lype of Meeting: Regular Place: Big Horn County Courthouse Date: September 4, 2012 Time: 9:00 a.m. Chairman: Jerold S. Ewen; Members Present: Keith (;rant, Thomas S. Hinman. Members Absent: None; County Clerk: l)ori Noyes; Deputy County Clerk: Wendy Thulander Others present various times: Karla t'omeroy, Basin Republican Rustler Meeting was called to order at 9:)) a.m., by: Chairman Ewen: followed by the Pledge of Allegiance led by Chairman Ewen. Chairman Ewen recognized guests. Motion was made by Keith Grant and seconded by Thomas S. Hinman to approve the agenda as amended. Motion passed unanimously. William Bridges, Pryor Mountain Engineering; Rod Wambeke and Jerry Denniston, BHC Road and Bridge Foremen; and Carl Meyer, Airport Manager: Cemetery Road: William said the work was done and good for a few years. Cold Springs Road: William said there were a couple signs still to install by the contractor. He will follow-up later today. Road 5: William said the contractor had scheduling conflicts and the project will be put off for two weeks to one month. He had concerns with oil being put down too late in the season. After talking more with the contractor, he will follow-up with Rod Wambeke on how to proceed and will report back tu the Commissioners. Commissioner (;rant said legacy was supposed to let the County know if they were interested in picking up the Schneider well lease, but he hasn't heard back yet. Eagle Pass Community Pit: William presented and recommended a BLM Free Use Permit for 2500 cubic yards of pit run. Motion was made by Keith Grant and seconded by Thomas S, Hinman to approve the Free Use Permit for Eagle Pass Community Pit. Motion passed unanimously. William Bridges reviewed WYI)OrIS Bridge Report with the Commission. He said the Shoshone River Bridge was one that had problems to address. Chairman Ewen felt the County needed to know how much it will cost to repair. He also felt it would be a good idea to speak with the Legislature about the off-system bridges from the WYDOT Bridge Report and discuss the need nf getting help with funding to repair the bridges. Road 11 1/2: William said he had gotten the easement for the road with the State. He said the report needed a signature from the County then a $2.00 submission with the report for the lease to State lands. No motion necessary. Chairman Ewen signed the report. William said he was still working on the Land Planning remodel. He will have the specs by the end of this week and will have bids to consider by next meeting. Commissioner (;rant asked about John Hyde's remodel and funds left over from the consensus money. Dori Noyes will look up references of this money from past meetings. Jerry Denniston addressed the following: Lane 41: Graveling on Lane 41 was started and will be finished this week. Fueling Tanks: No bids were in yet for the tank repairs. Work will be required to be OSHA compliant. Scrap Iron: Bids had been received for the scrap iron. Loader: A bid was received for repairs to the 957 Loader and it will be two weeks to get it done. Lane 35: There are issues on cattle guards and the right-of-way. William Bridges said the extent of the ownership or right-of-way had not been made clear and that the County does not have right-of-way or ownership. Jerry Denniston said he had been told not to blade past the gate because it is on private property. William Bridges said it was a dead issue at this point. Bear Creek Road: The County road stops at the private property line and there is no easement past that point. William felt it might be good to pursue an easement tO the intereefion0ffile Bear Creek Mesa Road. He vall contact the landowner to see ffthey are agreeable. Rod Wambeke addressed the following: ", Road 6: There is a two-mile section they are graveling. A new employee, Jeff Johnson, was recently hired.. County Clerk Dori Noyes asked to set up a time with Rod Wambeke and Jerry Denniston to work on their budgets. Chairman Ewen asked that everyone review and provide feedback on the draft version of the Big Horn County R & B Foreman Job Description. The County Attorney has reviewed and approved. Chairman Ewen said he wanted to table it in order to provide time for the foremen to review and report back to the Commission. Carl Meyer, Big Horn County Airport Manager: Revenue Report: The revenue report was presented and placed on file with the County Clerk. Airport Report: The monthly report was presented and placed on file with the County Clerk. Dori Noyes read the June 6, 2012, Minutes regarding John Hyde's remodel project referencing the $21,000 bid. Chairman Ewen presented a letter addressing hydraulic fracturing on Federal lands. Motion was made by Keith Grant and seconded by lerold Ewen to approve the letter from Joel Bousman, President, Wyoming County Commissioners Association to the U.S. Department of Interior, BLM regarding RIN 1004-AE26 Oil and Gas; Well Stimulation, including Hydraulic Fracturing, on Federal and Indian Land, proposed rule published in the Federal Register on May 11, 2012 (77 Fed. Reg. 27691). Commissioner Scotty Hinman opposed the letter and the motion. 10:15: Chairman Ewen called for a break; resumed regular session at 10:28. Dori Noyes presented Dirty Annie's 24 hour liquor license request. Motion was made by Thomas S. Hinman and seconded by ]erold Ewen to allow the Dirty Annie's Country Store 24-hour liquor license to be issued for a fund raising event on September 24, 2012, at the Big Horn County Library. Commissioner Keith Grant was opposed to liquor being sold in a government building and voted against the motion. Doff Noyes will schedule a working meeting for the Commissioners within five days of today to review & interview the proposed candidates for the Clerk of the Court position. Accounts Payable: Marquerite Van Dyke and Carol Willard presented the current Big Horn County bills for approval. Marquerite Van Dyke reported that scheduled dates for the Wellness Clinics are September 13  & 14 th and the 27 th & 28  between 7:00-9:00 a.m. Mgtion was made by Keith Grant and seconded by Thomas S. Hinman to approve the proposed changes to the Personnel Policy to Wellness regarding sick leave and payout policy regarding language clarifications and Workers Compensation changes which were all discussed at a previous meeting. Chairman Ewen signed. Grants Update Report: Maria presented her monthly report which is now on file at the County Clerk's office. Maria advised there was $12,650.30 from the Countywide Consensus which will be used to upgrade the county building in Lovell. She will make a new application to SLIB as an Amend/d Restltititfi .... '  : Dori Noyes returned to the meeting at 1:15 p.m. Dori Noyes presented draft Minutes for the Regular Board Meeting of August 21, 2012. Beck to the Weed & Pest Board. Motion passed unanimously. Chairman Ewen presented correspondence from M. Scott McColloch regarding Lovell Refinery Site Quiet Title Action. Motion was made by Keith Grant and seconded by Thomas S. Hinman to retain services of Scott McCoUoch for this one time project for the approximate sum of $900.00. Motion passed unanimously. Motion passed unanimously. The meeting was reconvened at 1:52. It was the consensus of the Board to take no action. Chairman Ewen read an e-mail from the Governor ordering flags to be flown at half-mast in honor of Army Spc. Mabry Anders, who was killed in an attack by an Afghan army soldier The Commissioners expressed their concerns and prayers for the Anders family. Ruth Zeller, Big Horn County Weed & Pest: An oral report was presented, addressing Weed & Pest activities over the summer. Joy Hill, Big Horn County Land Planning Office: Joy Hill requested an Executive Session for a personnel issue. 2:07: Motion was made by Keith Grant and seconded by IhnmaS.Miaman to go into Executive Session. Brent Godfrey, Big Horn County Fire Chief called into Commission Meeting per Becky Lindsey's request. The need to purchase Brent a new pickup for Firewise trainings so he doesn't have to use his own vehicle was presented. Motion was made by  and seconded by aomz, s2dtinmaa to approve the purchase of a truck contingent upon Forest Service approval. Motion passed unanimously. Buddy Grosvenor, Big Horn County resident, and Sheriff Blackburn: Buddy Grosvenor advised the Commissioners that he has continued problems with a crop-duster who flies at extremely low levels during aerial application of chemicals. He advised the Commissioners that he has never been hit directly, but is very concerned about he or his properties being sprayed with unknown chemicals. Carl Meyer said that the FAA is the agency that has jurisdiction over the airspace, and the State of Wyoming is the agency that issued the aerial applicator's license. Mr. Grosvenor was advised he would need to contact FAA or the State to report possible violations in the future. 3:58: Chairman Ewen called for a Break. Regular meeting was reconvened at 4:12. Chairman Ewen requested an Executive Session for a personnel issue. 4:14: Motion was made by Keith Grant and seconded by Thomas S. Hinman to go into a Executive Session. Motion passed unanimously.
